The application process for an H-1B visa in the US is alone is not really that complicated. There is an easy step by step application process that you see on the website of USCIS. There is an H-1B visa Regular Processing and an H-1B Premium Processing. Regular processing takes around 3 to 6 months while premium processing only takes 15 days but has an additional cost of $1,225.

The H-1B visa processing, in general, goes like this:

    1. H-1B visa sponsoring company files a petition to the USCIS on your behalf. The application should include the offer letter containing the information about the position, duties of the position, dates of employment, and location of work.

    2. File for Labor Certification Application (LCA). This is a form that makes the sponsor agree to give the H-1B recipient the correct wage and other benefits, which includes health, medical, retirement, leaves, and bonuses.

    3. Once the LCA is approved, the Department of Labor will provide the H-1B sponsor with a certified copy. The sponsor will then post notices of the H-1B filing for 10 days.

    4. The Sponsor will file the H-1B petition to the correct USCIS Service Office. This step includes the submission of forms, documents, fees, and employment agreement.

5.Once the petition is received by the USCIS, it will issue a receipt to the H-1B sponsor.

    6. Issuance of petition approval by the USCIS and the release of Form I-791, the approval notice which includes the validity dates of the visa.

However, if the number of H-1B visa petitions on that fiscal year reached the limit of 65,000, the issuance of H-1B visa will go into a lottery or random selection.

Note: This is not a legal advice.
